Cameroon’s New Constitutional Council Amendment: Law No. 2026/004: In April 2026, Cameroon enacted Law No. 2026/004, amending and supplementing provisions of Law No. 2004/004 of 21 April 2004 on the organization and functioning of the Constitutional Council, as previously updated by Law No. 2012/015 of 21 December 2012.
This latest amendment introduces significant clarifications regarding the vacancy of the office of the President of the Republic.
Key Highlights of the Amendment
- Resignation Procedure: The President of the Republic must tender resignation to both the President of the Constitutional Council and the Vice-President of the Republic.
- Permanent Incapacity:
- The Constitutional Council is empowered to ascertain permanent incapacity in line with Article 6(5) of the Constitution.
- The Vice-President of the Republic refers the matter to the Constitutional Council.
- A ruling requires a two-thirds majority of Council members.
- Publication of Ruling: Any ruling on permanent incapacity must be published urgently and inserted in the Official Gazette in both English and French.
